THE ‘RIGHT OF ACCESS’
Under the Data Protection Act 1998 and the GDPR, individuals have the right to obtain:
Sunderland Empire Theatre Trust will provide a copy of the information free of charge. However, Sunderland Empire Theatre Trust may charge a reasonable fee or refuse to respond when a request is manifestly unfounded or excessive, particularly if it is repetitive. Sunderland Empire Theatre Trust may also charge a reasonable fee to comply with requests for further copies of the same information.
The fee will be based on the administrative cost of providing the information.
Information will be provided without delay and at the latest within one month of receipt. Sunderland Empire Theatre Trust may extend the period of compliance by a further two months where requests are complex or numerous. If this is the case, Sunderland Empire Theatre Trust must inform the individual within one month of the receipt of the request and explain why the extension is necessary.
Where staff and/or associates refuse to respond to a request, they will explain why to the individual, informing them of their right to complain to the supervisory authority (ICO) and to a judicial remedy without undue delay and at the latest within one month.
In responding to a request, Sunderland Empire Theatre Trust will verify the identity of the person making the request, using reasonable means. If the request is made electronically, Sunderland Empire Theatre Trust may provide the information in a commonly used electronic format.
Data subjects should contact the Sunderland Empire Theatre Trust to correct or request information that Sunderland Empire Theatre Trust holds about them.
THE ‘RIGHT TO RECTIFY INACCURACIES’
Sunderland Empire Theatre Trust will ensure that any personal data they process is accurate, adequate, relevant and not excessive, given the purpose for which it was obtained. They will not process personal data obtained for one purpose for any unconnected purpose unless the individual concerned has agreed to this or would otherwise reasonably expect this.
Individuals may ask that Sunderland Empire Theatre Trust correct inaccurate personal data relating to them. If an individual believes that information is inaccurate they should record the fact that the accuracy of the information is disputed and inform the Privacy and Compliance Manager.
THE ‘RIGHT TO REQUEST DATA PORTABILITY’
The right to data portability allows individuals to obtain and reuse their personal data for their own purposes across different services. It allows them to move, copy or transfer personal data easily from one IT environment to another in a safe and secure way, without hindrance to usability.

Sunderland Empire Theatre Trust must respond without undue delay, and within one month. This can be extended by two months where the request is complex or Sunderland Empire Theatre Trust receives a number of requests. Staff and associates must inform the individual within one month of the receipt of the request and explain why the extension is necessary.
Where Sunderland Empire Theatre Trust is not taking action in response to a request, they must explain why to the individual, informing them of their right to complain to the supervisory authority (ICO) and to a judicial remedy without undue delay and at the latest within one month.
THE ‘RIGHT TO BE FORGOTTEN’
The right to erasure is also known as ‘the right to be forgotten’. The broad principle underpinning this right is to enable an individual to request the deletion or removal of personal data where there is no compelling reason for its continued processing.
The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where the personal data are no longer necessary in relation to the purposes for which they were collected or the data subject withdraws consent.
If Sunderland Empire Theatre Trust has disclosed the personal data in question to third parties, it must inform the data subject about the erasure of the personal data, unless it is impossible or involves disproportionate effort to do so.
THE ‘RIGHT TO OBJECT’

THE ‘RIGHT TO RESTRICT PROCESSING’
Individuals have a right to ‘block’ or suppress processing of personal data. When processing is restricted, staff and associates are permitted to store the personal data, but not further process it. They can retain just enough information about the individual to ensure that the restriction is respected in future.
